Study on the Implementation Situation of the General Administrative Law

At the request of the Ministry of Justice and Home Affairs - one of its official partners in Mongolia - the HSS has been providing advisory support in the drafting of the General Administrative Law since 2010.

Since the above-mentioned law came into force on July 1, 2016, the HSS has been working intensively with the aforementioned ministry to disseminate it to the public and to provide further training for lawyers.

 

In the course of the nationwide training measures, the need for a study to determine the implementation situation of some specific provisions of the Act has emerged. In this context, the foundation formed a monitoring team together with the above-mentioned ministry, which monitored the implementation situation of 38 paragraphs from a total of 10 sections of the law between March and June 2018 with the aim of determining any need for amendments or rewording and identifying overlaps or conflicts with other laws.

The monitoring team evaluated the current implementation situation of the law, commented on necessary measures and drew up a summary including recommendations. A short summary of the study in English can be found here.

From 2019, the Foundation plans to provide advisory support on the modernization of commercial legislation at the request of partner organizations.
