Conception of the constitution: current challenges

The Mongolian Lawyers' Association organizes an annual forum among the country's lawyers with the aim of supporting the obligations of lawyers in society and their contributions to social progress, facilitating an exchange of expertise and bringing about legal policy discussions on current controversial issues and making recommendations to the public in this regard.

On October 21, 2022, after a two-year break due to the coronavirus, the regular 'Jurists' Forum 2022' took place at the 'Ulaanbaatar' hotel, attended by representatives from all legal disciplines.

 

The main session of the forum was held between 9:25 am - 1:20 pm under the topic 'The conception of the Constitution, current challenges', in which the following presentations were given:

  1. "Protection of constitutional values - scientific basis" - Prof. Dr. jur.habil. Ts. Sarantuya,
  2. "The principle of the supremacy of the law enshrined in the Constitution" - Dr. (PhD) jur. P. Odgerel,
  3. "The basic structure of the constitution, its principles and constitutional amendment" - Dr. (LLD) jur. O.Munkhsaikhan.
  4. "The role of the Constitutional Court in strengthening the constitutional state, current challenges" - Dr. jur. (Ph.D) V. Udval,
  5. "Constitutional guarantee of property rights: contradictions and risks" - Dr. jur. (Ph.D) Т.Mendsaikhan,
  6. "Critical analysis of decision no. 2/2022 of the Constitutional Court" - Mag. Jur. A. Bazar.

Part 2: Free discussion

Afterwards, lawyers had the opportunity to hold a free discussion on the respective topics. Dr. jur. Sh. Tsogtoo - judge at the Constitutional Court - gave a summary of the main session at the end. 

 

In the afternoon, the forum took place in side sessions on the following constitutional, administrative, civil and criminal law topics:

  • "Conception of the constitution - questions of basic structure",
  • "Ensuring the protection of fundamental rights through effective protection of administrative jurisdiction",
  • "Guarantee of property rights through civil law",
  • "Protection of constitutional values through criminal legislation".

A total of 16 presentations were given on the four areas of law mentioned above. Around 300 lawyers and researchers took part in this fourth lawyers' forum. The forum will produce joint recommendations and summaries for all four areas of law.
