Assessment of Judges and Public Prosecutors in Bavaria

In Germany, judges for life and public prosecutors for life are assessed transparently every four years by their immediate superior, taking into account their professional performance, suitability and aptitude.

Transparent means that the assessment for the judges and public prosecutors should not be a  cloak-and-dagger operation. It takes place in consultation with the respective judge or public prosecutor. They have access to the draft appraisal and can clear up any misunderstandings, because the performance appraisal is an essential basis for every personnel decision.

 

The personal and factual independence of the judges must not be impaired by the assessment. For example, no comment may be made on the content of individual judicial decisions.
