Administrative Law, No. 11: Administrative Contract

It took a while for the term administrative contract to be recognized. Until the emergence of this term, administrative law relationships were seen exclusively as relationships of superiority and subordination.

The basic idea of the management contract is derived from Jean-Jacques Rousseau's theory of the social contract. This states that "Man must not have power over other men, who are by nature equal to him. The basis of any legitimacy of power is founded exclusively on contract".
